GENERAL TERMS AND CONDITIONS
German Open West Coast Swing Championships
(As of: 01.01.2024) General Terms and Conditions (T&Cs) for:
GERMAN OPEN WEST COAST SWING (hereinafter GO-WCS)
Preamble
By booking a festival ticket, the following terms are acknowledged and become effective. This applies to all GO-WCS tickets.
Organizer
The organizers of the above-mentioned festivals are Christian Spengler & Gutmann Events GmbH & Co. KG, Freiburg im Breisgau. Any claims must always be directed against the organizer. GO-WCS takes place at the Ballhaus in Freiburg im Breisgau.
Bookings, Cancellations, and Rebookings
All ticket bookings — whether booked online or purchased in person on-site at the day or evening box office — are binding and cannot be transferred to another person. For online orders, the purchase area includes a registration form that must be completed in full. Before submission, acceptance of these T&Cs is required. Final confirmation follows receipt of payment.
Payment
All ticket bookings are payable by bank transfer, without deductions, to the bank account specified in the confirmation email. A ticket only becomes valid once full payment has been received within the stated payment deadline. Please note: fees arising from international bank transfers are borne by the buyer. When using PayPal, the costs are likewise borne by the buyer.
FreePasses & Vouchers
FreePasses won through competitions are only valid in the year they were issued. All discounts must be stated directly at the time of registration and cannot be taken into account retroactively. The text field in the registration form is to be used for this purpose. FreePasses must be redeemed by April 1 of the event year. After this date, a place can no longer be guaranteed.
Refunds for Non-Attendance
Your booking is binding. In the event of non-attendance (regardless of the reason), 75% of the amount paid will be refunded. It is irrelevant whether the reason for non-attendance was known in advance or only arose on the first booked festival day or evening itself. Discounts from prize draws, partner promotions, competition credits, etc. are not taken into account here; excluded from this are cash-value discounts such as previously purchased gift vouchers. All visitors who have not exchanged their pre-purchased ticket for an entry wristband, etc. by 5:00 p.m. on the last booked festival day are considered to have been unable to attend and not present at the festival. Partial payouts are not possible; arriving only on Saturday, for example, does not entitle the holder to a refund for a Friday ticket, etc. Excepted from this are bookings for multiple people on a single invoice where tickets are only partially collected. In this case, a 75% refund will be issued for the portion of the booking for which no tickets were collected. This provision does not apply to hotel bookings or other costs incurred in connection with the festival (such as travel, postage, etc.). A refund requires written notification (by email or letter) to info@go-wcs.com within 30 days of the end of the festival.
Collection and Use of Tickets
All day and multi-day tickets are issued exclusively directly at on-site check-in, upon presentation of an official photo ID or against cash payment at the day or evening box office. Check-in is open during the times announced on the event website during the event days. Tickets may also be purchased on-site, subject to availability. Admission wristbands must not be misused, copied, or altered. By using the admission wristband, the user also expressly accepts the house rules of the Ballhaus Freiburg. Full and event passes are issued in the form of control wristbands. On the respective day, before attending any festival offering such as workshops, etc., these must be fastened to the wrist in such a way that they cannot be slipped over the hand. They must be worn throughout the entire event and shown upon request. Once a control wristband is removed or cut, it becomes invalid. No replacement wristbands can be provided.
Event Cancellation, Changes, Refunds
Changes to the lineup or program (dance teachers, workshops, shows, etc.) remain reserved. In the event of the festival’s cancellation, ticket(s) may be returned within 60 days of the originally planned end of the event for a refund of the purchase price, via the same channel through which they were purchased. In the event of cancellation, postponement, or changes to the program or lineup, no costs (e.g. for travel, hotel, advance booking, or processing fees) will be reimbursed.
“Pandemic” ADDENDUM: For the period during which official regulations regarding a pandemic are in place, the following applies:
Should only parts of the event (here, primarily the evening events) be cancelled due to official regulations or economic considerations on the part of the organizer, you will receive a full refund of the portion of your paid participation fee corresponding to the cancelled value. The cancellation of individual parts of the event does not entitle the holder to withdraw from a booking, provided and insofar as the event otherwise takes place.
Liability
The registrant and each participant expressly acknowledge that neither the organizer Christian Spengler nor Gutmann Events GmbH & Co. KG assumes any liability, and that they attend the workshops, seminars, and evening events within the scope of the event at their own risk. The registrant/participant alone is liable for any injuries or damages. The organizer is liable for damages caused by its vicarious agents only in cases of intent and gross negligence. We do not guarantee any particular learning outcome from the course content.
Data Protection
All information on data use and data protection can be found here.
Photography / Video Recording / Copyright
The organizer points out that photography and filming take place as part of the above-mentioned festivals. Films and photos of all persons present (festival participants, visitors, artists, etc.), or excerpts, compilations, etc., may be published. At the same time, films and photos may also be used for promotional and advertising purposes (e.g. website, flyers, press releases, TV and cinema spots, etc.) for the festival (current year and all subsequent years); this also includes further commercial purposes (resale of photos and image rights). By registering for the above-mentioned festivals, the customer expressly agrees to the — for them free of charge — publication of photos and film recordings taken of them. Personal recordings (video, photo, etc.) may only be made during the last five minutes of each workshop. Violations will incur a fee of €300. In such cases, the organizer is also entitled to demand the surrender of any existing photo or film material without compensation. In the event of repeated violations, a visitor may be excluded from the festival. All usage rights to photo and video material remain with GO-WCS and David Goffin (photographer), or with previous rights holders.
Miscellaneous
Smoking is generally not permitted in the event premises.
Jurisdiction
The place of jurisdiction is Freiburg im Breisgau.
